These are the terms of service for Hollywood Metrics. They describe the agreement between you and the small company that operates this platform: what we provide, what we expect from you in return, who owns what, how payment works, what happens when something breaks, and the law that resolves any disagreement we cannot solve over email. It is written to be read by a human, not survived by one.
By creating an account, subscribing to a paid tier, or otherwise using the platform, you accept these terms. If you do not accept them, do not use the platform. We are a solo-operated company with no legal department, so when you write in about something in this document, the founder reads it directly. That is a feature, not a bug.
You own your screenplay. We own the platform. Predictions are statistical estimates, not guarantees of any commercial outcome.
01 / Acceptance of Terms
By accessing or using Hollywood Metrics (the “Service”) you agree to these Terms of Service and to our Privacy Policy, which is incorporated by reference. If you are using the Service on behalf of a company or other entity, you represent that you have the authority to bind that entity to these terms, and “you” in this document refers to that entity.
If you do not agree with any part of these terms, you may not use the Service. Continued use after a revision of these terms constitutes acceptance of the revision. The last-updated date at the top of this page is bumped on every revision; material changes are also announced via email to registered users before they take effect.
02 / Your Account
To use most features you create an account via Firebase Authentication, either with Google sign-in or with an email address and password you choose. You agree to provide accurate information, to keep your credentials confidential, and to notify us promptly at alcheon.ai@gmail.com if you suspect your account has been compromised.
You are responsible for all activity that takes place under your account, including activity by anyone you have given access to your credentials, until you report a breach. Each account is for an individual user; you may not share a single account between multiple humans or resell access to your seat. Studio-tier accounts that include multiple seats are billed per seat under the same rules.
You must be at least sixteen years old to create an account. Hollywood Metrics is intended for professional and serious amateur screenwriters, producers, and industry analysts; it is not directed at children, and we do not knowingly accept accounts from anyone under sixteen.
03 / Payment & Billing
Hollywood Metrics offers four subscription tiers: a free Creative tier with no payment required, Writer at $9 per month, Producer at $99 per month, and Studio at $999 per month. Annual billing is offered at a discount; the discount is calculated and displayed at checkout. All prices are in U.S. dollars and exclude any applicable taxes.
All payment processing is handled by Stripe, Inc. Your card details are entered directly into a Stripe-hosted iframe and are never seen or stored by Hollywood Metrics. We retain the brand, last four digits, expiry, and outcome of each charge so we can recognise the card and show it back to you.

We do not issue automatic refunds for unused time after a cancellation, because you retain full access through the end of the paid period. If you believe you have been charged in error (duplicate charge, charge after cancellation, charge during a documented platform outage that materially prevented your use), write to alcheon.ai@gmail.com within thirty days of the charge and we will investigate. We err on the side of refunding when the dispute is reasonable.
Failed payments are retried by Stripe according to their standard schedule. If a payment fails repeatedly your account is downgraded to the free Creative tier and any tier-gated saved work remains in place but becomes read-only until the subscription is reinstated. We never auto-delete data because of a billing failure.
04 / Acceptable Use
You agree to use the Service in good faith and within the limits each tier defines. The following are explicitly out of bounds, and any one of them is grounds for immediate suspension of your account:
- Quota evasion. Creating multiple accounts to circumvent per-tier rate limits, using automation to issue API calls beyond the tier you pay for, or sharing API keys with parties not on your subscription.
- Scraping the catalogue. Automated extraction of the underlying film catalogue, prediction outputs, tier assessments, or any other data product through means other than the documented API at the rate your tier permits.
- Reverse-engineering. Attempting to derive the source code, training data, model weights, feature extraction algorithms, or proprietary scoring formulae from the Service's outputs, traffic, or binaries.
- Resale. Reselling access to the Service, repackaging API output as your own paid product, or white-labelling Hollywood Metrics without a written agreement signed by the founder.
- Infringement. Uploading or transmitting content you do not have the right to upload, content that infringes a third party's intellectual property, or content that violates applicable law.
- Abuse of other users. Using the Service to harass, threaten, defame, or otherwise harm another user, the founder, or any third party.
- Security probing. Attempting to gain unauthorised access to accounts, servers, or data; transmitting malicious code; or running denial-of-service attacks against the Service or its processors.
- Training-data extraction. Using the AI features to mass-generate outputs for the purpose of training a competing model. The features exist so you can write better screenplays; they are not a free pipe to a foundation model.
If you discover a security issue, please report it responsibly to alcheon.ai@gmail.com. Good-faith security research that follows responsible disclosure norms is welcomed, will not be retaliated against, and will be credited if you wish.
05 / Intellectual Property
Hollywood Metrics retains all rights, title, and interest in the Service, including the website, the underlying database of film records, the twenty-feature quantitative engine and the model artefacts derived from it, the prediction algorithms, the editorial copy on these pages, the visual identity, the trade dress, and the trademarks and service marks displayed on the Service. Nothing in these terms grants you a license to those assets except the limited, revocable right to use the Service as documented.
You retain all rights, title, and interest in any screenplay, scene, character sheet, treatment, or other creative work (“Your Content”) you upload to or generate through the Service. We do not claim a license to Your Content, we do not train models on Your Content, and we do not sell, share, or sublicense Your Content to any third party. The privacy policy describes this in operational detail.
Aggregate, anonymised statistics derived from product usage — which dashboard tabs are most popular, which prediction features convert best, which decade pages get the most traffic — are owned by Hollywood Metrics. These statistics cannot be re-keyed to you or to Your Content and do not contain any personally identifying information.
06 / Your Content
If you upload a screenplay or paste a scene for analysis, the content stays in your browser. The privacy policy explains this in technical detail: PDF parsing, DOCX parsing, and the quantitative engine all run client-side. Hollywood Metrics does not receive Your Content unless you click an AI feature button (rewrite, deep analysis, oracle, simulation), in which case the relevant portion is sent to the upstream AI provider over TLS, processed, and the response returned.
For the AI-feature pathway only, you grant Hollywood Metrics a limited, non-exclusive, revocable license to transmit the relevant portion of Your Content to the upstream AI provider you have selected by clicking the feature, solely so that the feature can be executed and the result returned to your session. This license expires the moment the response is delivered. We do not log the content of these requests on our side; the upstream provider's zero-retention policy applies on theirs.
If you publish content on a Hollywood Metrics surface that other users can see (community comments, public profile blurb, shared analyses, if and when these features ship), you grant Hollywood Metrics a non-exclusive, royalty-free, worldwide license to host, display, and distribute that content within the Service so that the feature can work. This license ends when you delete the content or your account.
You represent and warrant that you have the legal right to upload or transmit Your Content through the Service and that doing so does not infringe any third party's rights. If we receive a credible takedown notice (DMCA in the United States, equivalent elsewhere) we will act on it promptly.
07 / AI Features & Limits
The AI features — script rewrite, deep analysis, oracle, simulation, and any successor — call out to bespoke agents running on third-party model providers (currently Anthropic and Google). They are executed only when you explicitly click a button that triggers them; they do not run in the background, and they do not run on stored copies of Your Content because we do not store Your Content.
Each tier has a documented monthly quota of AI calls. The quota resets at the start of each billing period. Quota counters are visible in the dashboard and exposed via the authenticated API. Exceeding the quota returns a standard rate-limit response with the reset timestamp; requests in excess of the quota are not partially fulfilled and not charged for.
Outputs of the AI features are generated by autonomous agentic workflows and may be inaccurate, incomplete, or in rare cases reflective of biases in the training data of the upstream model. You should treat AI output as a creative partner's draft, not as authoritative analysis or as financial, legal, or professional advice. You are responsible for reviewing AI output before relying on it for any consequential decision.
08 / Termination
You may terminate your account at any time by cancelling your subscription in the dashboard and emailing alcheon.ai@gmail.com to request data deletion. The privacy policy describes the deletion sweep in detail. You retain access through the end of the paid period; we do not delete your saved analyses until you ask us to.
Hollywood Metrics may suspend or terminate your account if you materially breach these terms, including any provision of the Acceptable Use section above. Where the breach is ambiguous or appears unintentional we will notify you in writing and give you a reasonable opportunity to cure. Where the breach is egregious (fraud, security attack, mass scraping, threats to other users) we may suspend immediately and explain after the fact.
On termination by either party, your right to use the Service ends. Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) survive termination.
PREDICTIONS ARE STATISTICAL ESTIMATES, NOT GUARANTEES.
Every quantitative output of this Service — box-office forecasts, tier predictions, audience simulations, oracle calls — is a model's best guess given historical patterns. Each guess carries an explicit confidence interval and known failure modes. Read them as one input to your judgement, never as a substitute for it. Cinema is chaotic; the model is humble enough to know.
Section 09 below states this with the full legal weight. The shorter sentence above is the one a court will quote.
09 / Predictions Are Not Guarantees
Box office forecasts, tier predictions (S through E), audience-reaction simulations, oracle calls, and every other quantitative output of the Service are statistical estimates produced by mathematical models trained on historical data. They carry confidence intervals, error bars, and known failure modes that are documented in the methodology pages of the Service.
They are not guarantees. They are not financial advice. They are not investment recommendations. They are not legal advice. They are not a substitute for the judgement of an experienced producer, distributor, financier, or talent representative. A film that the model rates highly may underperform; a film the model rates poorly may become a phenomenon. Cinema is one of the more chaotic markets human beings have ever invented, and any forecaster who tells you otherwise is selling something.
You agree that you will not rely on any prediction or quantitative output of the Service as the sole basis for any commercial, financial, legal, or creative decision. You will apply your own professional judgement and, where appropriate, the judgement of qualified advisers.
10 / Disclaimers & Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, Hollywood Metrics disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of a course of dealing, usage, or trade.
Without limiting the generality of the foregoing, we do not warrant that the Service will be uninterrupted, error-free, secure against every conceivable attack, or that any particular content, feature, or model output will be available, accurate, or persistent. We do not warrant that the Service will meet your specific requirements. We do not warrant the accuracy or completeness of any data, prediction, tier assessment, or AI output produced by the Service.
Some jurisdictions do not allow the exclusion of certain warranties; the disclaimer above applies to the maximum extent permitted in your jurisdiction.
11 / Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Hollywood Metrics, its founder, its contractors, or its processors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of business opportunity, loss of data, loss of goodwill, or loss of any other intangible, arising out of or related to your use of or inability to use the Service, regardless of the cause of action and regardless of whether Hollywood Metrics has been advised of the possibility of such damages.
In any case where the limitation above does not apply, the aggregate liability of Hollywood Metrics for all claims arising out of or related to the Service in any twelve-month period is capped at the greater of (a) the total amount you paid Hollywood Metrics for the Service in that twelve-month period, and (b) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages; the limitation above applies to the maximum extent permitted in your jurisdiction.
12 / Indemnification
You agree to defend, indemnify, and hold harmless Hollywood Metrics and its founder from and against any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to (a) Your Content, (b) your violation of these terms, (c) your violation of any third party's rights, including any intellectual-property right, or (d) your violation of any applicable law. This indemnification obligation survives termination of your account.
13 / Governing Law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any action or proceeding arising out of or related to these terms or to your use of the Service shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.
Before initiating any formal proceeding, you agree to first contact us in good faith at alcheon.ai@gmail.com and attempt to resolve the dispute by email. Most things resolve over email; the courtroom is reserved for the things that genuinely cannot.
If any provision of these terms is found to be unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.
14 / Changes to These Terms
We update these terms when the product changes, when a relevant law moves, or when we discover the existing language is unclear. Material changes — anything that meaningfully alters your rights, our obligations, or the price you pay — are announced via email to registered users at least fourteen days before they take effect. Non-material changes (typo fixes, clarifications, formatting) take effect on the date the page is bumped.
The last-updated date at the top of this page is bumped on every revision, and a changelog of substantive changes is kept in the git history of the repository at web/src/app/terms/page.tsx. Continued use of the Service after a revision takes effect constitutes acceptance of the revision.
